John Park has wide ranging experience over 18 years in all manner of corporate law and commercial litigation including trade practices matters, banking/finance litigation, debt recovery, corporate/personal insolvency and corporate disputes.

With his business acumen combined with quality of advice and transactional skills, John’s clients vary from individuals to small medium enterprises, foreign listed companies, Korean Government agencies and a diverse range of privately held companies.

John also regularly advises private and public sector clients (including Korean government owned corporations/government agencies, Korean global enterprises, financial institutions and statutory bodies) which carry businesses in Australia on regulatory issues, corporate compliance/governance, corporate structure and planning.

John is fluent in English and Korean. 

John is a member of Korean Chamber of Commerce and Korean Chamber of Commerce & Industry in Australia.

The following are some of John’s expertise:

  • establishment of foreign owned corporations/agencies in Australia;

  • advising on various policies and regulatory compliance to foreign companies investing in Australia;

  • advising company’s constitution/internal management rules and contract prior/following registration;

  • advising on compliance/procedure rules in calling members’ meeting and directors’ meetings;

  • advising on directors’ duties prior/during company’s management, liquidation and/or voluntary administration;

  • advising on acquisition and disposal of company assets/turnaround management; 

  • advising on liquidators’ duties in the course of investigating company’s affairs;

  • advising on creditors’ rights in attending creditors’ meetings;

  • corporate migration; and

  • drafting and reviewing various types of contracts including shareholder agreements, partnership agreements and joint venture agreements.

Some of John’s experience includes:

  • advising on various legal issues for Korean Government bodies/agencies in Australia including Consular General of Republic of Korea, Korea Trade – Investment Promotion Agency (KOTRA), Korea Cultural Office, Sydney and Korean Tourism Organisation;

  • acting for international and domestic consortiums at various stages in acquiring assets, land and Australian companies;

  • providing advice to client against company in liquidation;

  • advising on interpretation of various contracts for doing business in Australia

  • advising on issues associated with internal management compliance and issues involving employment law and reporting obligation to ASIC;

  • advising on issues involving company constitution following acquisition;

  • providing advice on various issues involved with joint venture agreement;

  • advising on procedures and relevant laws in setting up a branch/foreign corporation/subsidiaries in Australia;

  • acting for various international companies on restraint of trade in contracts; and

  • acting for client on restrictive trade practices, anti-competitive conduct involving primary boycotts (an agreement between parties to exclude another) and secondary boycotts.
